Terms of Service

1. Acceptance of Terms

By accessing or using Summitward (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Mount Si Labs LLC, a Washington limited liability company that owns and operates Summitward (“Mount Si Labs,” “we,” “us,” or “our”).

2. Description of Service

Summitward is a personal financial tracking and analysis tool provided by Mount Si Labs LLC. It provides net worth tracking, retirement simulation, portfolio analysis, tax planning tools, and related features. The Service is available in free and paid tiers with varying feature access.

3. Not Financial Advice; No Fiduciary Relationship

Summitward is not a registered investment advisor, broker-dealer, or financial planner under the U.S. Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), or any state securities regulatory authority.

All projections, simulations, analyses, and outputs provided by the Service — including but not limited to Monte Carlo retirement simulations, safe withdrawal rate calculations, Roth conversion recommendations, CEFR funded ratio scores, Fama-French factor regression results, tax projections, tax-loss harvesting analysis, and portfolio optimization — are for informational and educational purposes only and do not constitute financial, investment, tax, or legal advice.

No fiduciary relationship is created between you and Summitward by your use of the Service. You are solely responsible for your financial decisions. Past performance and model projections do not guarantee future results. Always consult a qualified financial advisor, tax professional, or attorney before making investment, tax, or legal decisions.

4. User Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for the accuracy of the financial data you enter.
  • You must notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or access the source code of the Service beyond what is publicly available on GitHub.
  • Interfere with or disrupt the Service or its infrastructure.
  • Share your account credentials with others or allow multiple individuals to use a single account.
  • Use automated systems (bots, scrapers) to access the Service without prior written permission.
  • Redistribute, resell, or sublicense any part of the Service.

6. Subscriptions and Billing

Summitward offers a free tier and a paid “Summit” tier. The Summit tier is available at $9.99 per month or $99 per year (prices subject to change with 30 days' notice). New Summit subscribers receive a 14-day free trial with no credit card required.

Paid subscriptions are billed in advance on a recurring basis through Stripe. You may cancel at any time from your billing settings; access continues through the end of the current billing period. No prorated refunds are issued for partial billing periods. Refunds for exceptional circumstances are handled on a case-by-case basis.

By subscribing, you also agree to Stripe's Terms of Service as they relate to payment processing.

7. Data Ownership

You retain ownership of all financial data you enter into Summitward. We do not claim any intellectual property rights over your data. You can export your data at any time via CSV from the Settings page.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOUNT SI LABS LLC, ITS MEMBERS, OFFICERS, AGENTS, EMPLOYEES, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • FINANCIAL LOSSES ARISING FROM INVESTMENT, TAX, OR RETIREMENT DECISIONS MADE BASED ON PROJECTIONS, SIMULATIONS, OR OTHER OUTPUTS OF THE SERVICE;
  • ERRORS OR INACCURACIES IN MONTE CARLO SIMULATIONS, ROTH CONVERSION RECOMMENDATIONS, FACTOR REGRESSION RESULTS, OR ANY OTHER ANALYTICAL OUTPUT;
  • LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES;
  • SERVICE INTERRUPTIONS, DOWNTIME, OR UNAVAILABILITY;
  • FAILURES OF THIRD-PARTY SERVICES (INCLUDING STRIPE, HOSTING PROVIDERS, OR DATA SOURCES);
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.

IN ANY CASE, MOUNT SI LABS LLC'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO MOUNT SI LABS LLC DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. MOUNT SI LABS LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. MOUNT SI LABS LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

10. Accuracy of Simulations and Projections

Summitward's analytical tools use statistical models based on historical data and mathematical assumptions. You acknowledge and agree that:

  • A “95% success rate” in a Monte Carlo simulation is a statistical estimate based on historical return distributions, not a prediction or guarantee of future outcomes.
  • Projections assume market behavior will resemble historical patterns, which may not hold true in the future.
  • Tax calculations are based on current tax law and IRS brackets, which are subject to change.
  • Roth conversion recommendations are estimates that do not account for all individual tax circumstances.
  • CEFR funded ratio scores are based on the liability and asset data you provide and the assumptions embedded in the model.
  • Factor regression results depend on the time period analyzed and the specific model selected (CAPM, FF3, FF5, Carhart).
  • All outputs should be verified with a qualified financial advisor before acting on them.

11. Intellectual Property

The Summitward name, logo, and proprietary software are the intellectual property of Mount Si Labs LLC. You may not use our name, logo, or branding without prior written permission. Open-source components of the Service are governed by their respective licenses.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mount Si Labs LLC and its members, officers, agents, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to:

  • Your use of or inability to use the Service;
  • Financial, investment, or tax decisions you make based on the Service's outputs;
  • Your violation of these Terms;
  • Your violation of any third-party rights.

13. Third-Party Services

The Service integrates with or relies on third-party services including Stripe (payment processing), Google Analytics 4 (website analytics), PostHog (product analytics), Sentry (error monitoring), and Vercel (hosting). Summitward is not responsible for the availability, accuracy, or practices of these third-party services. Your use of these services is governed by their respective terms and privacy policies.

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved as follows:

  1. Good-faith negotiation: The parties shall first attempt to resolve the dispute through informal negotiation for a period of 30 days.
  2. Binding arbitration: If the dispute is not resolved through negotiation, it shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in California.

Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.

15. Age Requirement

You must be at least 18 years old to use Summitward. By using the Service, you represent and warrant that you are at least 18 years of age. If we learn that a user is under 18, we will terminate their account.

16. Force Majeure

Summitward shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet outages, power failures, cyberattacks, pandemics, or failures of third-party service providers.

17. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from the Settings page. Upon termination, your right to use the Service ceases immediately. Sections 3, 8, 9, 10, 12, and 14 survive termination.

18. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
